TERMS OF SERVICE

These Terms of Service (“Terms”) govern all orders, transactions, services, and interactions with Stitches n’ Clothes (“Company,” “we,” “us,” or “our”). By placing an order, submitting payment, or engaging our services in any manner, you (“Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms.

1. PAYMENT TERMS

The following payment methods are accepted:

  • Zelle: Payments may be sent to (714) 419-7114

  • Card Payments (Stripe): Subject to a 6% processing fee, applied to the total invoice amount

  • Company Check or Cash: Accepted. Cash transactions will always be accompanied by a receipt, check must be cleared before any production and in-person verification may be required (we never will respond to check sent through mail) must note: ORDER NUMBER/INVOICE #

All payments must clear prior to production commencement unless otherwise agreed to in writing. Returned or rejected payments may result in order suspension, delays or cancellation.

2. ORDER ACCEPTANCE & PRODUCTION

All orders are considered custom production orders unless expressly stated otherwise.

  • Production begins upon payment receipt and order confirmation

  • Processing timelines vary based on order size, complexity, customization and production capacity

  • An estimated completion date will be provided at confirmation; all dates are estimates, not guarantees

Stitches N’ Clothes shall not be held liable for delays caused by supply chain issues, equipment maintenance, force majeure events or factors beyond reasonable control. Any material changes to timelines will be communicated when known.

3. DELIVERY, SHIPPING, & PICKUP

  • Local delivery is available for a flat fee of $45

  • Local pickup is available at no additional charge

  • Non-local shipping rates are calculated based on package size, weight, and destination

Once an order is released to a carrier or collected by the Customer, responsibility transfers to the Customer. Stitches N’ Clothes is not liable for carrier delays, loss, theft, or damage once delivery or pickup occurs.

4. CANCELLATIONS, REFUNDS, & PAYMENTS

  • Orders may be canceled within 24 hours of placement for a full refund, provided production has not commenced

  • Cancellations after 24 hours will result in forfeiture of any upfront or partial payments as production costs, labor and materials are immediately incurred

  • No refunds will be issued once an order has entered production, been completed, delivered, or picked up

All printed, embroidered, customized or altered items are final sale unless otherwise required by law.

5. QUALITY STANDARDS & CLAIMS

Stitches N’ Clothes maintains professional commercial production standards.

  • Quality concerns must be reported within 5 calendar days of delivery or pickup

  • Claims submitted after this period will not be considered

  • Any resolution, including repair or replacement, is determined solely at the Company’s discretion

Normal industry variances in color, placement, sizing or material texture are not considered defects.

6. CUSTOMER RESPONSIBILITIES

The Customer is solely responsible for:

  • Providing accurate, production-ready artwork and specifications

  • Ensuring files are high-resolution and suitable for commercial output

  • Verifying spelling, sizing, colors, quantities, and placement

Stitches N’ Clothes is not responsible for errors resulting from incorrect, low-resolution or unapproved files supplied or approved by the Customer.

Approval of proofs, mockups, or verbal confirmation constitutes final authorization to proceed.

7. INTELLECTUAL PROPERTY & INDEMNIFICATION

Customers represent and warrant that they own or have lawful rights to all artwork, logos, and content submitted. The Customer agrees to indemnify and hold harmless Stitches N’ Clothes from any claims, damages, or legal actions arising from intellectual property infringement.

All Company branding, processes and original designs remain the exclusive property of Stitches n’ Clothes.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Stitches n’ Clothes shall not be liable for indirect, incidental, consequential, or economic damages

  • Liability is strictly limited to the amount paid for the specific service or product in dispute

  • Shipping costs, third-party fees and processing charges are excluded from liability

9. RIGHT TO REFUSE SERVICE

Stitches n’ Clothes reserves the right to refuse or discontinue service at its discretion, including but not limited to cases involving abusive behavior, fraudulent activity, policy violations or misuse of services.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

11. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the Customer and Stitches n’ Clothes and supersede any prior agreements, representations, or understandings.

By placing an order, submitting payment or engaging our services, you confirm acceptance of these Terms.
